Terms of Service

These Terms of Service («Terms») govern your access to and use of the WowPostio AI website and platform (collectively, the «Service»), operated by WowPostio AI («we», «us»). By creating an account or otherwise using the Service, you agree to these Terms.

1. The Service

WowPostio AI is a SaaS platform that helps small and medium businesses plan, generate (using third-party AI models) and publish content for their Instagram Business or Creator accounts via the official Instagram Graph API. Additional channels and features may be added over time.

2. Eligibility and account

You must be at least 18 years old.
You must own (or be authorised to manage) the Instagram Business / Creator account you connect.
You are responsible for keeping your login credentials confidential and for all activity under your account.

3. Acceptable use

Because WowPostio publishes on your behalf to Meta-operated platforms, you must comply at all times with:

Meta’s Platform Policy and Platform Terms;
The Instagram Community Guidelines;
The Meta Community Standards;
All applicable laws of your country and the country you target.

You also agree not to use the Service to:

Upload, generate, schedule, or publish content that you do not own or are not licensed to use — including photos, videos, music, logos, brand assets, third-party copy, or material scraped from other Instagram, TikTok, or web sources;
Send unsolicited messages, spam, or perform auto-DM, auto-comment, auto-follow, auto-like, mass-coordinated inauthentic behaviour, fake-engagement schemes, follow/unfollow churn or any other automated action prohibited by Meta;
Impersonate another person, brand, or business, or misrepresent your affiliation with them without authorisation;
Generate, schedule, or publish content that is prohibited, including but not limited to:
- Child sexual abuse material (CSAM) or any content sexualising minors — zero tolerance;
- Sexually explicit, pornographic, or nudity-containing content (Instagram prohibits this under Meta Community Standards);
- Illegal drugs, narcotics, controlled substances, or related paraphernalia; tobacco, e-cigarette, or vaping promotion where restricted by law; alcohol marketing directed at minors;
- Firearms, ammunition, explosives, or weapon modification instructions;
- Gambling or betting promotion in jurisdictions where it is not licensed; prostitution, escort services, or other sexual services; human trafficking;
- Counterfeit goods, stolen credentials, stolen payment cards, or other illicit goods and services;
- Hate speech, harassment, doxxing, threats, terrorist content, violent extremism, or content promoting self-harm or suicide;
- Deceptive medical or health claims, miracle cures, dangerous dietary advice;
- Financial fraud, pyramid or Ponzi schemes, fake investment opportunities, crypto rug-pulls, scam content, phishing.
Attempt to reverse engineer, scrape, or overload the Service or its underlying APIs, or bypass rate limits and authentication;
Resell, sublicense, or white-label the Service without our written permission.

You may report suspected violations of these rules to abuse@wowpostio.com.

4. AI-generated content and reference materials

AI generations may contain inaccuracies, fabricated facts, or unintended likenesses. You are solely responsible for reviewing every piece of AI-generated content before scheduling or publishing it under your Instagram account.
By uploading reference materials (photos of yourself or staff, brand assets, product images, logos, prior posts, training data for AI avatars or voice clones), you certify and warrant that you own the necessary rights or have written permission from every identifiable person and rights-holder, and that the material does not infringe any copyright, trademark, publicity, or privacy right.
You retain ownership of the prompts and reference materials you provide and grant us a non-exclusive licence to use them solely to operate the Service for you. We do not use your content or Meta-sourced data to train third-party foundation models.
To the extent permitted by the underlying AI providers, you own the generated outputs you publish under your account, subject to those providers’ terms.

5. Subscriptions, fees, refunds

Paid plans are billed in advance on a monthly or annual basis via Stripe.
Plans renew automatically until cancelled. You can cancel at any time from your dashboard; the cancellation takes effect at the end of the current billing period.
Fees already paid are non-refundable except where required by law. For subscriptions purchased in jurisdictions with statutory cooling- off periods (e.g. EU/UK), you may request a refund within the legally required window.
We may change pricing with at least 30 days’ notice for the next billing cycle.

6. Third-party services

The Service integrates with third parties including Meta (Instagram Graph API), OpenAI, Anthropic, Google, HeyGen, ElevenLabs, fal.ai, Supabase, Stripe, Vercel and Inngest. Their respective terms apply to your use of those services through WowPostio. We are not responsible for third-party outages or policy changes.

7. Intellectual property

The Service, including its software, design and trademarks, is owned by WowPostio AI. We grant you a limited, non-exclusive, non- transferable licence to use the Service for your business during your subscription. All other rights are reserved.

8. Disclaimer of warranties

The Service is provided «as is» and «as available». To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non- infringement. We do not guarantee specific business outcomes (reach, followers, sales) — examples on the Service are illustrative.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including lost profits or data.

10. Suspension, content removal and termination

You may terminate your account at any time from the dashboard.

We reserve the right, at our sole discretion, to suspend or terminate your access to the Service, with or without prior notice, and to remove or refuse to publish any individual piece of content (post, caption, image, video, voiceover, comment reply) — without terminating the entire account — for any of the following reasons:

Breach of these Terms, including the Acceptable use rules in §3 or the reference-materials warranties in §4;
Use of third-party copyrighted, trademarked, or otherwise protected material without rights (photos, logos, brand assets, music, text, or content scraped from other Instagram or web sources);
Generating, scheduling, or attempting to publish any prohibited content listed in §3 (including but not limited to CSAM, illegal drugs, weapons, adult / sexually explicit content, hate speech, terrorist content, financial fraud, scams, counterfeit goods);
Impersonation, spam, fake-engagement schemes, mass-coordinated inauthentic behaviour, or other automation prohibited by Meta;
Action required by Meta, Instagram, a payment provider, a court, or another competent authority (for example, if Meta revokes our API access for your account or if Instagram bans the connected account);
Non-payment of fees or chargebacks;
Activity that creates a security, legal, or operational risk to the Service, to us, or to other users.

Immediate termination without notice. For severe violations — including suspected CSAM, credible threats of violence, active fraud, security attacks against the Service, or any conduct we are legally required to act on — we may suspend or terminate access immediately and without prior notice. Where the law requires it (notably for suspected CSAM), we will preserve evidence and report to the relevant law-enforcement authorities or NCMEC.

Notice and appeal for non-severe cases. For non-severe breaches we will, where reasonably practicable, give you notice of the violation and a short window to remedy it or to appeal the decision by replying to abuse@wowpostio.com. We are not obligated to provide notice or an appeal where the breach falls into the severe category above or where notice would prejudice an investigation.

Refunds on termination. If we terminate your access because of your breach of these Terms, prepaid fees for the current billing period are non-refundable. If we terminate the Service entirely (not for your breach), we will refund the unused portion of any prepaid fees on a pro-rata basis.

On termination, your data is removed in accordance with our Privacy Policy and Data deletion procedure. We may retain limited records (e.g. evidence of severe violations, invoices required by tax law) for the minimum period required by applicable law or to defend legal claims.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified by email or in-product banner at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where WowPostio AI is incorporated, without regard to its conflict-of-laws rules. Disputes will first be resolved in good faith via direct negotiation; if unresolved, by competent courts of that jurisdiction. Mandatory consumer protection laws in your country of residence continue to apply.

Instagram and Meta are trademarks of Meta Platforms, Inc. TikTok is a trademark of ByteDance Ltd. OpenAI and GPT are trademarks of OpenAI, Inc. Claude and Anthropic are trademarks of Anthropic, PBC. Gemini is a trademark of Google LLC. WowPostio AI is not affiliated with, endorsed by, or sponsored by any of these companies. Integration with Instagram is performed exclusively via the official Instagram Graph API in accordance with Meta’s Platform Terms.
